Regulatory Authority (RERA) in Maharashtra (MahaRERA) has expanded its compliance guidelines, clarifying
that open plotting layout developments and bungalow townships are fully under its jurisdiction. This
means land buyers enjoy the exact same legal protections, escrow rules, and penalty structures that
apartment buyers have always relied on.
Before MahaRERA's
strict intervention, buying plots from unorganized developers carried substantial layout design risks.
Here's why RERA registration is an absolute must-verify for land buyers:
1. Escrow Account Protections (Financial Security)
Every RERA-registered
plotted development must maintain a dedicated project escrow account. Developers are legally mandated to
deposit 70% of all client bookings directly into this account, which can only be withdrawn for
construction and infrastructure development costs of that specific project, eliminating fund diversion.
2. Bound by Official Layout blueprints
Once a plotting
township is registered on the RERA portal, the developer cannot modify the sanctioned layout, plot
dimensions, road alignments, or green space margins without receiving written consent from at least
two-thirds of the individual plot allottees, preventing bait-and-switch practices.
3. Guaranteed Possession Timeline for Roads & Service lines
RERA rules bind
developers to strict delivery timelines for core common amenities—including tar roads, street lighting,
drainage systems, water supply setups, and overhead tanks. Any delivery delay beyond the declared date
gives buyers the legal right to claim monthly interest payouts.
